THE CURIOUS LEGAL STATUS OF CBD + HEMP-DERIVED CANNABINOIDS

There is no more fascinating area of rapidly developing U.S. state and federal Cannabis law than that surrounding cannabidiol (CBD) and all cannabinoids derived from industrial hemp, particularly given the mass confusion caused by a battle royal between the intent of the Federal legislators behind §7606 of the US Agricultural Act of 2014 and the Drug Enforcement Administration’s oppositional interpretation of that historical amendment. Is CBD legal in all 50 states, just some states, or not at all? Are there different legal statuses for CBD derived from hemp and CBD derived from marijuana? Is CBD a dietary supplement or drug, and is there a different status for imported raw materials and products versus domestic? Attendees will be guided through the myriad of evolving authority on which the U.S. has to rely as farmers, processors, manufacturers, merchants and consumers navigate their way through the promising waters of CBD and cannabinoids extracted from industrial hemp.
